This Privacy Policy describes how Darkelix ("We", "Us", "Our") collects, uses, and discloses information in connection with the Service, and how customers should think about the visitor data the Service captures on their behalf.
Darkelix sits in an unusual spot: We are a data processor for the visitor data captured by the pixel on Our customers' Sites, and We are also a data controller for the account and billing information of Our own customers. This policy covers both.
When a customer installs the Darkelix pixel on their Site, the pixel may capture: page views and engagement events, UTM parameters and ad click IDs, form field data (per the customer's own configuration), IP address and derived company/ASN information, and, where a customer has connected an outbound campaign token, a deterministic link between a known contact and their subsequent site visits. This data is collected and processed on the instructions of Our customer, who is responsible for having a lawful basis to collect it and for disclosing its use to their own site visitors. If You are a visitor to one of Our customers' sites and have a question about this, please contact that site owner directly; We can also honor verified deletion requests routed through Our customers.
The pixel honors the Global Privacy Control (GPC) browser signal: when GPC is enabled, no visitor data is collected for that visitor.
When You sign up for Darkelix directly as a customer, We collect information You provide, such as Your name, email address, company name, and billing details, in order to provide the Service, process payment, and communicate with You about Your account.
Our own marketing site uses minimal first-party cookies necessary for basic functionality. The Darkelix pixel, when installed on a customer's Site, uses a first-party identifier (cookie and/or local storage, depending on install type) to recognize repeat visits; see the Tracking Pixel documentation for details on what a specific installation captures.

We retain visitor data for as long as the customer's account remains active, per the retention window configured on their plan, and delete it on a rolling basis thereafter. Account and billing data is retained for as long as needed to provide the Service and to meet legal, tax, and accounting obligations.
We use commercially reasonable technical and organizational measures to protect data, including encryption in transit. No method of transmission or storage is 100% secure, and We cannot guarantee absolute security.

The Service is not directed to individuals under 16, and We do not knowingly collect personal data from them.
